McCathern Houston Partner Rodney Drinnon and Associate Danielle Chester recently won a unanimous jury verdict for their client with assistance from Associate Tatiana Lutomski and Paralegal Averyll Mauch. Drinnon and Chester represented the Executor of the Estate of a well-known physician in a three-day trial in Brazoria County.

On Wednesday, March 1st, they obtained a jury verdict in their client’s favor after less than thirty minutes of deliberation. This probate litigation involved a will contest, a formal objection raised against the will’s validity, brought by the Decedent’s two older children from a previous marriage for an estate valued at two million dollars. The Contestants were forced to dismiss several of their substantive claims for breach of fiduciary duty and conversion of the Estate property prior to resting their case-in-chief.  The unanimous verdict found no undue influence by the Executor and widow, who had three minor children with the Decedent.
